Given the result from the recent EU referendum, property tax law within the United Kingdom will become more complicated. SDLT.co.uk has prepared for ‘What-if Brexit’ with government agencies like HMRC, Revenue Scotland, Companies House et al. Informally, they have implied that nothing will change in terms of the progression to Digital by Default.

The existing ‘devolution’ of property tax is confirmed as a “will happen policy”.

It is particularly ironic, that last Wednesday saw the breakthrough by LBTTax.co.uk (a sister service to SDLT.co.uk) of seamless integration with Revenue Scotland for the SDLT equivalent. Revenue Scotland’s’ policy towards outside involvement has shall we say, been challenging and in complete contrast, to that of HMRC. Scotland now has a property tax eSubmission choice with Scottish conveyancers now eSubmitting to Revenue Scotland via LBTTax.co.uk.

Brexit; we believe will accelerate all of us towards the need to eSubmit and liaise with up to five devolved and clearly separate tax collection agencies.

Remember that Welsh SDLT devolution IS happening April 2018 so the Welsh Assembly, the 33 Boroughs of London and Northern Ireland are watching and learning of the differences and will form their own property tax solutions based on what works best. These new systems will affect the property law departments in each country differently and where the border is porous in legal terms YOU and your clients will be affected. From a practical perspective, all the new agencies will be separate portals, login IDs’ and information requirements. A simple (as was) SDLT solution will not achieve what practically is needed by your conveyancers in the future.
