Conveyancing Clerk banned and fined £7,500 over fake client emails

The SRA have banned a former conveyancing clerk from the profession for creating two emails supposedly from a client.

According to the SRA, Mr Graham Borley could have caused loss to the client as they purported to give instructions to the firm. The SRA say his current practising details are unknown.

Mr Borley was employed by Liverpool based Morecrofts LLP Between 1st June 2009 and 4th November 2014. As well as creating two emails reportedly containing instructions to the firm to use part of the funds held for this client to settle sums due on other matters that were unconnected with this client, it was found that Mr Borley took steps to conceal his actions and that his conduct misled the firm’s finance partner.

The SRA said: “It was found that Mr Borley’s conduct was dishonest and that his actions also breached Principles 2 and 6 of the SRA Principles 2011.

“Mr Borley was made subject to an order pursuant to section 43(2) of the Solicitors Act 1974 (as amended) and was given a written rebuke and ordered to pay a financial penalty of £7,500. He was also ordered to pay the SRA’s costs of £1,350 in investigation this matter.”
