HMLR Practice Guide updates: PG4 and PG5

HM Land Registry has published details of changes to Practice Guides 4 and 5.

Adverse possession of registered land (PG4)

This guide provides information about applications for adverse possession of registered land, the procedures for making these applications and the options available to anyone served with notice of such an application.

If information is required on adverse possession of unregistered land, or registered land where the squatter acquired the right to be registered as proprietor before 13 October 2003, see practice guide 5: adverse possession of (1) unregistered land and (2) registered land where a right to be registered was acquired before 13 October 2003.

Change made: Section 12 has been amended to clarify HMLR’s approach when dealing with applications involving adverse possession of part of a rentcharge.

 

Adverse possession of (1) unregistered land and (2) registered land where a right to be registered was acquired before 13 October 2003 (PG5)

This guide explains HMLR’s approach to applications based on adverse possession for (1) first registration of unregistered land and (2) registration as proprietor of registered land where a squatter was in adverse possession for the requisite limitation period so as to have acquired a right to be registered as proprietor before 13 October 2003. It also explains the procedures for making such applications, and the options available to those served with notice of them.

Change made: Section 8.3 has been amended to clarify HMLR’s approach when dealing with applications involving adverse possession of part of a rentcharge.
