Law Society Consultation on Property Information Form (TA6)

The Law Society have launched a consultation on the Property Information Form (TA6) (PDF), asking for views on how the form can be improved for conveyancers, buyers, sellers and lenders.
The consultation, which does not extend to leasehold, commonhold enquiries or new build, seeks to obtain views, particularly from Conveyancing Quality Scheme (CQS) members, that will aid work to improve the form, focusing on the content of the following forms:
TA6 Property Information Form 2nd Edition; and
TA10 Fittings and Contents Form 2nd Edition
Jonathan Smithers, Chair of the Conveyancing and Land Law Committee, commented:
"I am pleased to announce the launch of a consultation with the profession on the form of preliminary enquiries, currently Property Information Form (TA6).
Conveyancing Quality Scheme Firms have an obligation to use the forms, and to limit the additional enquiries to those which are relevant to the nature or location of the property or are specific to it.  It is important then to make sure that the form which we use is as comprehensive as possible, at the same time recognising what are proper legal limitations and being mindful of the costs involved for practitioners in advising their clients.
The consultation document is designed to be informative as to the background behind the forms and the reasons for particular types or groups of questions.  We want to hear from practitioners both as to the questions they think ought to be included and also those which should be excluded.  
The Protocol limitation on standard pre printed additional enquiries has struck a cord with the profession.  Having a new form, in which practitioners have had the opportunity to participate, should further encourage adoption of a common standard which ties in with the work which we have done on the Protocol, the Standard Conditions of Sale and the Code for Completion by Post."
