CLC Discipline and Appeals consultation

The Council for Licensed Conveyancers opened a consultation on Discipline and Appeals Arrangements on the 21 January.

We are really sorry that we missed covering this at the time, but there is still plenty of time to respond before the Friday 19 April deadline.

The consultation comes as a result of the Legal Services Act, with the CLC looking to ensure that the same regulatory arrangements and processes apply to those it regulates, whether as an Approved Regulator or as a Licensing Authority.

There is currently a mismatch between the appeals process for recognised bodies and licensed conveyancers, and for Alternative Business Structures.

The CLC is subsequently proposing that the appeals and disciplinary jurisdiction of the Discipline and Appeals Committee is transferred to the CLC’s Adjudication Panel, and that the entitlement to appeal from such determinations is transferred from the High Court to the First-tier Tribunal.
